Claims Advocacy
Effective and timely claims advocacy is essential if the Insurance product is to deliver the required level of protection, indemnity and support.Complex or large claims can become distressed for a variety of reasons.
Coverage disputes between Insured and Insurer may cause negotiations between parties to reach an impasse.
Negotiation fatigue or entrenchment of personalities and positions may cause discussions to reach such a point where formal dispute resolution or costly litigation appear the only remedy to total or partial repudiation of policy liability.
The failure of a policy to provide the range and extent of cover anticipated at time of placement may give rise to issues of conflict for the incumbent broker which may in turn hinder their attempts to settle a distressed claim.
Paragon welcomes the opportunity to assume responsibility for the handling of large and/or complex losses and assist in the negotiation and resolution of distressed claims.
We recognise that various factors and situations may create the need or corporate appetite for urgent settlement of an ageing claim.
These may include the following:
• Injection of unbudgeted income prior to the close of the Financial Year.
• Removal of a disclosed liability from a balance sheet.
• Avoidance of litigation and adverse publicity.
• Preservation of commercial relationships with third party claimant
• Limitation of legal cost and management downtime.
We would offer a preliminary coverage opinion and will provide a pragmatic and realistic assessment of the claim and prospects of recovery.
If appointed, Paragon will never lose sight of the fact that the interests of the client are paramount. We will attempt to achieve the best possible settlement and aim to resolve disputes with Insurers on an equitable and amicable basis. We ensure the client is constantly apprised of developments and are mindful of existing relationships.
We aim to link our fee to our success and are willing to work Advocacy cases on a contingent basis.
